The decision by the Salaries and Remuneration Commission to approve car grants to members of the county assembly may dive into headwinds even before its implementation.
This is after the matter was taken to court by a medical practitioner who wants the state barred from awarding the facility. In a matter certified as urgent, the petitioner, Dr Benjamin Magare Gikenyi insists that the salaries commission acted illegally in approving the conversion of car loans into car grants benefitting the speakers and county assemblies.
The physician specifically took issue with the award of Kshs.4.5 billion grant to MCAs claiming it was an inducement by President Uhuru Kenyatta to have them pass the Building Bridges Initiative constitutional bill.
“It’s easy to conclude that there is a nexus between the president promising the respondents and SRC approving the said conversion for a car loan to car grant.” He said in the petition.

This he says is grounds enough to stop the Lynn Mengich led commission from awarding the car grant.
“That an order do issue restraining the respondents, their agents, servants, successors, and or assigns from proceeding or in any way effecting the contents of the circular…. Pending determination of this application.” The doctor said in his petition.
He further argues that the matter was not subjected to public participation and as such the actions by SRC were illegal, irregular, and irrational.
